Jokati DigiLYNC Referral Program – Terms & Conditions

1. Overview The Jokati DigiLYNC Referral Program (“the Program”) is designed to reward individuals, professionals, and businesses (“Referrers”) who introduce new, eligible sellers to the DigiLYNC platform. By participating in the Program, you agree to be bound by these Terms and Conditions.

2. Eligibility of the Referrer

  • The Program is open to individuals (aged 18+), registered professionals, and businesses.
  • You do not need to be an existing Jokati or DigiLYNC customer to participate.
  • Employees of Jokati, or their immediate family members, are ineligible to participate.

3. Definition of a “Successful Referral” A Referral Fee is only payable when a referral is deemed “Successful.” A referral is successful when the referred party (the “Seller”):

  • Is New to Jokati: Has not previously registered or engaged with Jokati or DigiLYNC.
  • Completes Onboarding: Successfully completes the full DigiLYNC onboarding process.
  • Active Milestone: Remains active on the platform for a minimum of 90 consecutive days.
  • Transaction Milestone: Completes at least one (1) valid commercial transaction via the DigiLYNC platform within the first 90 days.

4. The Referral Fee

  • The Referral Fee is $1,000 (AUD) per Successful Referral.
  • There is no limit to the number of referrals a Referrer can make.
  • Payment will be made via bank transfer within thirty (30) days of all “Successful Referral” criteria being met and verified by Jokati.

5. Referral Submission & Verification

  • Submission: Referrals must be submitted via the official Jokati Contact Form with the “Referring a seller” checkbox selected, providing the Seller’s name and valid email address.
  • Relationship Verification: To ensure a high-quality network, Jokati will verify with the Seller that they have a pre-existing relationship with the Referrer.
  • Genuine Introduction: A referral is only eligible if the Seller acknowledges the introduction. “Cold” referrals or contact details submitted without the Seller’s prior knowledge (“Spamming”) will result in immediate disqualification from the Program.

6. Tax and Legal Obligations

  • Taxable Income: Referral fees are considered taxable income. Referrers are solely responsible for reporting and paying any taxes (including GST, if applicable) associated with the receipt of the Referral Fee.
  • ABN Requirements: For one-off referrals by individuals, an ABN may not be required. Frequent referrers may be required to provide an ABN or a “Statement by a Supplier” (Inquiry into a Hobby) declaration as per ATO guidelines.

7. Dispute Resolution

  • Priority: In the event that multiple Referrers refer the same Seller, the Referral Fee will be awarded to the Referrer who submitted the contact form first (based on the system timestamp).
  • Final Decision: Jokati reserves the right to determine, in its sole discretion, whether a Seller is “eligible” and whether the onboarding is “successful.” Jokati’s decision is final and no correspondence will be entered into regarding unsuccessful referrals.

8. Privacy and Consent

  • By submitting a referral, the Referrer warrants that they have obtained the explicit consent of the Seller to provide their contact details to Jokati for the purposes of this Program.

9. Program Modification and Termination

  • Jokati reserves the right to modify, suspend, or terminate the Program at any time. Any referrals submitted prior to a Program change or termination will be honored under the terms active at the time of submission.

10. Governing Law

  • These Terms and Conditions are governed by the laws of Queensland, Australia.
